Civil, employment, and family litigation across Michigan courts.

Shareholder

Randolph T. Barker is a Shareholder at Conlin, McKenney & Philbrick, P.C. and one of the firm’s most versatile attorneys, practicing across commercial litigation, employment and labor law, real estate and construction, municipal law, insurance defense, trust and estate litigation, and alternative dispute resolution.

Built to Try Cases, Trained to Settle Them

Randy represents management exclusively on workforce matters, including risk counseling, discipline and discharge, severance agreements, personnel policies, intellectual property and trade secret protection, compensation plans, and reductions in force. He defends employers in court and before administrative agencies on claims ranging from discrimination and harassment under Title VII and Michigan law to wage and hour disputes under the FLSA, FMLA claims, whistleblower actions, unfair labor practice charges, and non-compete enforcement. For unionized employers, he handles collective bargaining negotiations, grievance arbitration, and contract administration.

A mediator certified by the Michigan Supreme Court, Mr. Barker is regularly called upon by trial court judges, arbitrators, and fellow attorneys to facilitate resolution of commercial, employment, real estate, construction, and probate disputes.

On the Ground in Real Estate

Randy is also a licensed real estate broker, a credential that gives his transactional and litigation practice an industry perspective most attorneys cannot offer. He negotiates and drafts purchase agreements, commercial leases, construction and development contracts, condominium documents, and financing agreements. When disputes arise, he litigates title and boundary conflicts, zoning matters, nuisance claims, construction defect and delay cases, lien disputes, insurance coverage issues, and property tax appeals.

Randy is recognized among Michigan SuperLawyers, dBusiness Top Lawyers, and Michigan Leading Lawyers. The Detroit Association of REALTORS named him its 2017 REALTOR of the Year.

Mr. Barker earned his J.D., cum laude, from the University of Toledo College of Law and his B.A. from Eastern Michigan University. He is admitted to practice in Michigan, Ohio, the U.S. District Courts for the Eastern and Western Districts of Michigan, the U.S. District Court for the Northern District of Ohio, and the U.S. Court of Appeals for the Sixth Circuit.
